If you deposited fiat currency into an FTX- or Alameda-related account at Silvergate Bank between April 1, 2019, and November 11, 2022, and who, on November 11, 2022, still had an account on FTX.com or FTX.US that contained cryptocurrency, fiat currency, or both, then you may be a Settlement Class Member and eligible for settlement benefits. To receive benefits, you must file a claim form.
You are eligible to file a claim if all five of the following are true:
you sent or deposited fiat currency (e.g., U.S. dollars) into an FTX- or Alameda-related account at Silvergate Bank;
you sent the funds or made these deposits between April 1, 2019, and November 11, 2022;
as of November 11, 2022, you still had an FTX.com or FTX.us account;
your FTX.com or FTX.us account contained cryptocurrency, fiat currency, or both; and
you had no previous employment relationship or ownership interest in Silvergate, FTX, Alameda, or any of their related entities.
To receive settlement benefits, Settlement Class Members must file a Claim Form by January 30, 2026.
The defendants in this case are Silvergate Bank, Silvergate Capital Corporation, and Alan J. Lane. They have agreed to create a $10,000,000.00 fund to settle the case. This money will be used to pay for costs and lawyer fees approved by the Court, and for the cost of administering this settlement. The rest will be divided among the class members who file a valid claim form.
In exchange, class members will “release” their claims. This means they cannot sue Silvergate Bank, Silvergate Capital Corporation, or Alan J. Lane for the same issues and legal violations alleged in this lawsuit.
The payment amounts will depend on the number and value of all of the claims made. For now there is no estimate that amount.
